Please read these Terms and Conditions, along with the Privacy Policy and all other rules and policies made available or published on Exam with Arihant Platform, as they shall govern to use on the Exam with Arihant Platform or/any Exam with Arihant Software, data feeds and service provided to you on, from, or through the Exam With Arihant. Hereby, you signify your agreement to (1) these “Terms & Conditions”, (2) Exam with Arihant’s Privacy Policy and any other terms that are updated from time to time.
Note: If you do not agree to any of these terms, please do not use the Exam With Arihant platform.

By using or accessing the Exam with Arihant Platform (website or App) in any way, including registering on platform, using, viewing, sharing, embedding and/or downloading any services, you agree to be bound by the Exam with Arihant Policies including but not limited to the Exam with Arihant privacy policy and Exam with Arihant and Exam with Arihant Copyright Policy.
IF YOU DO NOT UNDERSTAND ANY OF THE TERMS USE OR DO NOT AGREE WITH OR DO NOT ACCEPT ANY PART THEREOF, YOU SHOULD IMMEDIATELY DISCONTINUE USING OR ACCESSING THE PLATFOM. YOUR USE AND/OR CONTINUEED USE OF PLATFROM, AS CASE MAY BE AMOUNTS TO EXPRESS CONSENT BY YOU TO THIS TERMS OF USE AS WELL AS OTHER EXAM WITH ARIHANT POLICIES.

We do not represent or guarantee that this platform will be free from errors or viruses. You acknowledge that this website may be affected by outages, faults or delays. Such outages, faults or delays may be caused by factors, including technical difficulties with the performance or operation of our or another person’s software, equipment or systems, traffic or technical problems with the Internet or infrastructure failures.
We do not accept responsibility for any loss or damage, (however damaged caused through negligence), that you may directly or indirectly suffer in connection with your use of this platform, nor do we accept any responsibility for any such loss arising out of your use of or reliance on information contained on or accessed through this platform.

ACCOUNTS

In order to access some of the features of the Exam with Arihant platform, you may have to create your account with Exam with Arihant. You agree and confirm that you will never use another User’s account and not provide access to your account to any third party. When creating your account, you confirm that the information so provided is accurate, complete, and Up to date. Further, you agree that you are solely responsible for activities that occur your account, and you shall keep your account password secure and not share the same with anyone. You must notify at Exam with Arihant platform immediately of any breach of security or unauthorized use of your account. At no point in time Exam with Arihant or Arihant Publication will/shall be liable for any losses caused by any unauthorized use of your account, you will/shall solely be liable for the losses cause to Exam with Arihant or others due to such unauthorized use, if any.

ELIGIBLITY

By agreeing to these Terms of Use, you represent that you are legally competent to enter into an agreement and provide contents to these Terms of Use.

The download of, and access to any Digital Content is available only to Customers and is intended only for such Customers’ personal and non-commercial use. Any other use of Digital Content downloaded or accessed from the Service is strictly prohibited. Customers may or should not modify, transmit, publish, participate in the transfer or sale of, reproduce, create derivative works from, distribute, perform, display, or in any way exploit, any of the content of any Digital Content, in whole or in part. By downloading or otherwise accessing Digital Content from the Service, the Customer hereby acknowledges and agrees to these terms.

LICENSE AND ACCESS

Exam with Arihant grants you a non-exclusive, non-transferable and limited sub-license to access and make personal use of this platform, solely on your computer or any other electronic viewing device for your personal, non-commercial use of this Platform. Exam with Arihant here by grants you permission to access and use the platform to set forth in these terms and conditions provided that:
1. You agree not to distribute in any medium or any part of the Exam with Arihant Platform or the content without the Exam with Arihant’s Prior Written authorization.
2. You agree not to alter or modify any part of the Exam with Arihant and it’s content
3. You agree not to access the content of any other user through any means of technology or means other than the Test portal pages Exam with Arihant itself.
4. You agree not to use the Exam with Arihant Platform for any commercial uses unless you obtain license from Arihant Publications India Limited

RESCTRICTION AND TERMINATION OF USE

This User Agreement is effective unless and until terminated by either you or the company. You may terminate this User Agreement at any time, provided that you discontinue any further use of the website. Exam with Arihant may block, restrict, disable, suspend or terminate your access to all or part of the free Services offered on the platform, at any time in Exam with Arihant’s sole direction, without giving any prior notice to you. Specifically, in case of prolonged inactivity, Exam with Arihant (website and/or App) reserves all the right to disable, deactivate or terminate a user’s account. If an account has been disabled or deactivated for inactivity, The Username or User-ID associated with that account may be given to another user, without notifying to you or such other party. If you violate any part of Terms & Condition, Exam with Arihant may at its sole discretion, block, restrict, disable, suspend or terminate the paid services offered on the Platform.

USER CONTENT

“Exam with Arihant” (Website and/or App) provides its users with the option of creating posts and/or uploading their content on the Platform that will be regarded as “User Content”. When you submit or upload any of your content on the platform you represent and warrant that:
• You own all copyright in the content, or if you are not the owner, you have permission to use the content, and that have all the rights and permissions necessary to permit uploading, displaying, sharing, reproduction, downloading and transmission of such content.
• The User content you upload should not infringe the intellectual property rights or other rights of any person or entity, including but not limited to copyright, moral rights, Trademark, Patent or right of privacy or publicity.
• Your usage of the Platform will comply with all applicable laws, rules and regulation
• The User content should not contain material that defames or vilifies any person, people, races, religion or religious groups and is not obscene, pornographic, indecent, harassing, threatening, harmful, invasive of privacy or publicity rights, abusive, inflammatory or otherwise objectionable.
• The User content should not be misleading and deceptive and should not offer or disseminating fraudulent goods, services, schemes, or promotions.
Exam with Arihant reserves the right to review such content uploaded by the user and in case any content is found to be a violation of any of the Terms of Use and/or any applicable laws, Exam with Arihant may remove any content from the Platform and/or terminate or suspend the user account in its sole discretion.

INTELLECUTAL PROPERTY

The Exam with Arihant Platform, the processes, and their selection and arrangement, including but not limited to all text, graphics, User interfaces, visual interfaces, sounds and music (if any), artwork and computer code on the Exam with Arihant Platform is owned and controlled by Exam with Arihant and the design, structure, selection, coordination, expression, look and feel and arrangement of such content mentioned hereinabove is protected by copyright, patent and trademark laws, and various other national and international IPR laws and regulations. For clarity, content in the above sentence shall not include User Content.
You agree not to copy, republish, frame, download, transmit, modify, adapt, create derivative works based on, rent, lease, loan, sell, assign, distribute, display, perform, license, sublicense or reverse engineer the Platform and Services or any parts thereof or the selection and arrangement of the Platform and Services, except as expressly authorized herein. Exam with Arihant grants you a non-exclusive, non-transferable, limited permission to access and display the web pages within this Platform, solely on
your computer or any other compatible electronic viewing device for your personal, non-commercial use of this Platform. This permission is conditional on the basis that you shall not modify, alter or illegally use the content displayed on this Platform and shall keep intact and comply with all copyright, trademark, and other proprietary notices of the Platform, if any. The rights granted to you constitute a license and not a transfer of title in any manner.
Use of the Platform or Services for any other purpose other than expressly granted hereunder is expressly prohibited and may result in severe civil and criminal penalties. In relation to any content submitted, uploaded or generated by you on the Platform, you hereby grant an unconditional, unlimited, perpetual, royalty-free, worldwide license and permission to Exam with Arihant and its affiliates, content sharing partners to display, store, host, publish, digitally reproduce or copy, transmit, communicate, modify, translate, distribute or otherwise make such content available on the Platform or in relation to the Services provided by Exam with Arihant. You agree that such content may continue to be made available on Exam with Arihant despite any termination or suspension of your account, if such content has been shared, stored or embedded by any other user(s). You agree not to hold Exam with Arihant responsible for the aforesaid activities in relation to your content.

COPYRIGHT INFRINGEMENT

1. Exam with Arihant operates on a clear copyright policy in relation to any User Content alleged to infringe the copyright of a third party.
2. As part of Exam with Arihant copyright policy, we reserve the rights to terminate User access to the Exam with Arihant Platform if a User has been determined to be a infringer.
3. If you believe that your work has been copied in a way that constitutes copyright infringement, please refer to the instructions given below in the copyright policy on how to make a claim of copyright infringement.
Approach us through the procedure set out under the applicable provisions of the Information Technology Act. If you have a good faith belief that your copyright has been infringed by any of our Users, you may follow the below process:

d. Your email address, your physical address and telephone or mobile number;
e. A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
f. A statement by you, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.

INDEMNITY

To extend permitted applicable by law you agree to defend, indemnity and hold harmless to Exam with Arihant, its parent corporation – Arihant Publication, Officers, Directors, Employees and agents for and against any and all claims, damages, obligation, losses, liabilities, Cost or Debts and expenses (including but not limited to attorney’s fees) arising from
1. Your use and access to the Exam with Arihant Platform
2. Your violation of any terms of These Terms and Conditions
3. Your violation of any third party right, including without limitation any copyright, property, or privacy right;
4. Any claim that your user content caused damage to a third party; or
5. Violation of any applicable laws. This Defence and indemnification obligation will survive these terms and conditions and your use of the Exam with Arihant Platform.

GOVERNING LAW AND JURISDICTION

The Terms and Conditions are governed by and constructed in accordance with the laws of India, without reference to conflict of laws principles and you irrevocably and unconditionally submit to the exclusive jurisdiction of the courts located in New Delhi, New Delhi, India.

CONFIDENTIALTIY

You will not without obtaining prior written consent of Exam with Arihant, disclose to third party any confidential information (as defined below) that is disclosed to you during the Terms of Your use of the Exam with Arihant Platform.
For the purpose of this clause Confidential Information shall include but shall not be limited to employee details, User list, Business Model, Processes, Ideas, Concepts, etc. relating to Arihant Publication and/or Exam with Arihant Platform which are not available in the public domain. You acknowledge and agree that the Confidential Information so provided to you shall at all-time be the property of Exam with Arihant and any breach o of the same shall cause irreparable damage to us.

RESRICTION AND TERMINATION OF USE

Exam with Arihant may block, restrict, disable, suspend or terminate your access to all or part of the free services offered on the platform, at any time in Exam with Arihant’s Sole discretion, without any prior notice to you. Specifically, in case of prolonged inactivity Exam with Arihant reserves the right to disable, deactivate, or terminate a user’s account. If an account has been disabled or deactivated for inactivity, the username associated with that account may be given to another without any prior notice to you or such, other party. If you violate any other terms of use, exam with Arihant may at its sole discretion, block, restrict, disable, suspend, or terminate the paid services offered on the platform.

AMENDMENTS TO THE TERMS AND CONDITIONS

Exam with Arihant may amend the Terms of Use and other Exam with Arihant Policies published on the Platform from time to time at its sole discretion. Your continued access or use of the Platform and the Services constitutes your acceptance of the amendments. Your access and use of the Platform and Services will be subject to the most current version of the Terms of Use, Privacy Policy and Copyright Policy posted on the Platform at the time of such use. Please regularly check the Platform to view the latest version of Exam with Arihant Policies.

CANCELLATION POLICY

Cancellations will be considered only if the cancellation request is made within 24 hours of placing the order. However, the cancellation request will not be entertained if the orders have already been completed or if we have initiated the process of shipping either by ourselves or through the vendors/merchants/representatives whom we may appoint from time to time.
No cancellations are allowed for products on which we have given special offers for various purposes including but not limited to special occasions like New Year, festivals, specific examination etc. These are limited validity offers and therefore cancellations are not possible.
In case you feel that the product received is not as shown on the site and/or as per your expectations, you must bring it to the notice of our customer service within 24 hours of receiving the product. The customer service team, after looking into your complaint, will make an appropriate decision.

REFUND POLICY

Once you have placed your order and made your payment, it shall be considered as Final. The refund is applicable for our products/services only until it’s dispatched or the login details for online access to test material etc. are disclosed/dispatched to you. We will not be in a position to change / modify or cancel your order once it is shipped.
We do have a FREE Returns Policy, only if
(i) It is determined that the wrong product was delivered.
(ii) It is determined that the product delivered was damaged.
You can cancel your order anytime before it has been shipped to you. As per Payment Gateways' Policy in case of cancelled orders your money will be refunded to the bank account used for making the payment within 3-5 banking days. In case of National Holidays the payment settlement might get rescheduled.

OTHER LAWS

Certain laws require maintaining data with respect to the Exam with Arihant Platform and other personal information in a prescribed format and Exam with Arihant will use all the information to the extent required in compliance with the applicable laws and as may be directed or amended from time to time.

PRIVACY POLICY

Your privacy is important to us. Users of our Platform should refer to our Privacy Policy, which is incorporated into this Terms of Use by reference, with respect to the disclosure, collection, storage, usage, and protection of your information during the course of your interaction with the Platform.

EXAM WITH ARIHANT SUBSCRIPTION

Your use of the Exam with Arihant subscription service is subject to the rules of the service set out herein, which Exam with Arihant might change from time to time on its website and mobile Application. Your continued use of the Exam with Arihant subscription service constitutes acceptance of the rules.
Exam with Arihant subscribers may examine themselves with their choice of eTest portals from a selected set of Digital Content for a monthly fee. The Digital Content available to subscribers will vary and Exam with Arihant makes no guarantees of any kind about the availability of such Digital Content.

SUBSCRIPTION AND ELIGIBILITY

Exam with Arihant Subscription (the “Subscription Service”) is a personalized Subscription that offers, recommends and helps you to discover the digital educational content created by Arihant Experts (collectively, “Educational Content”) in the category of your interest. You can access the Subscription and Educational Content, through the Exam With Arihant website or Exam With Arihant Mobile Application by subscribing to any category of your choice from the available subscription plans (“Subscription”). The Subscription will allow you access to all the courses and subject that are on-going during your subscription period.
(If you are under 18 years of age, you may use the Subscription only with involvement of a parent or guardian. We personalize content and feature them as part of the Subscriptions, including showing you recommendations on Educational Content in the subscribed category, features and other related categories that might be of interest to you. We also endeavor to continuously improve the Subscriptions and subscription plans to improve your subscription experience.)

COMPATIBLE DEVICES

In order to access the Test portals or to download the Educational Content in the mobile application, you will need to use a personal computer, portable media player, or other device that meets the system and compatibility requirements (a "Compatible Device"). The Compatible Devices may change from time to time and, in some cases, whether a device is (or remains) a Compatible Device may depend on software or systems provided or maintained by the device manufacturer or other third parties. Accordingly, devices that are Compatible Devices at one time may cease to be Compatible Devices in the future. Thus, kindly make sure that the device that you use is compatible with our system/software to avail the Subscription Service.

DOWNLOADING

You shall have option to do in-app & Website download, and the downloaded Educational Content can be viewed by you during the Subscription Period in your compatible devices. After downloading the Educational Content, you shall have access to the same for the Subscription Period only and all access to the downloaded content shall be removed on expiry or termination of your Subscription, as the case maybe.

SUBSCRIPTION & PAYMENT

You can subscribe to the category of your choice by clicking the Subscribe option and making the required payment for the subscription plan of your choice.

MEMBERSHIP CANCELLATION

You may cancel your membership by using the “Cancel my subscription” button on the Exam With Arihant Website or Mobile Application. Except as otherwise set out in these Terms of Use, and Exam with Arihant’s Terms of Sale, if you cancel your membership, you will not receive any refund of any membership fees already paid. When your membership is cancelled, the Digital Content associated with your subscription account will be removed from your devices and applications.
